PRIVACY, DATA USE & COOKIE POLICY

Last Updated: September 1st, 2026

The Jacobs & Cushman San Diego Food Bank (“San Diego Food Bank,” “SDFB,” “we,” “us,” or “our”) respects your privacy. We do not sell your personal information.

This Privacy, Data Use & Cookie Policy (“Privacy Policy”) explains how we collect, use, disclose, retain, and protect information when you access or use the Virtual Food Drive platform, including its websites, Campaign pages, fundraising tools, and related services (collectively, the “Platform”). It also explains our use of cookies, analytics, and similar technologies and the choices you may have regarding your information.

The Platform allows individuals, businesses, organizations, and other groups to create and participate in virtual food drives (“Campaigns”), form teams, make donations, participate in leaderboards and other Campaign activities, and support the mission of the San Diego Food Bank.

The Platform may in the future also be made available for use by other participating food banks or nonprofit organizations (“Participating Organizations”). Where applicable, additional privacy disclosures may apply.

Before using the Platform or providing information through it, please review this Privacy Policy.

1. INFORMATION WE COLLECT

The information we collect depends on how you interact with the Platform.

Information You Provide to Us

When you create an account, organize or participate in a Campaign, make a donation, join a team, communicate with us, or otherwise use the Platform, we may collect information such as your name, email address, organization or company affiliation, account information, team information, Campaign information, fundraising goals and dates, logos, photographs, Campaign descriptions, comments, messages, communication preferences, and other information you choose to provide.

If you create or manage a Campaign, we may also collect information about your Campaign configuration, administrative actions, Campaign activity, team activity, and reporting activity.

If you provide information about another person through the Platform, you should only provide information that you have the right or appropriate permission to provide.

Donation and Transaction Information

When you make a donation, we may collect information associated with that donation, such as your name and contact information, donation amount, Campaign or team, selected virtual food items, transaction date and status, public or anonymous recognition preference, and information needed to administer the donation or provide a donation receipt.

Payment card, bank account, or other financial information needed to complete a transaction may be collected directly by a third-party donation or payment provider rather than by the Virtual Food Drive Platform. We do not intend for VFD to store complete payment card or bank account information when that information is collected and processed directly by a third-party provider.

Information Collected Automatically

When you use the Platform, we and our service providers may automatically collect certain technical and usage information. This may include your IP address, browser and device type, operating system, pages viewed, features used, referring pages or sources, approximate location derived from your IP address, dates and times of access, session information, interactions with the Platform, and error or performance information.

We may use cookies and similar technologies to collect some of this information as described below.

2. SOME PARTS OF THE VIRTUAL FOOD DRIVE ARE PUBLIC

Virtual Food Drives are designed to encourage participation, teamwork, fundraising, and friendly competition. As a result, certain parts of a Campaign may be visible to other participants or the public.

Depending on the Campaign, Platform functionality, and your selections, publicly displayed information may include Campaign names and descriptions, organization or company names, Campaign logos and images, team names and profile images, donor names, donation amounts, Campaign and team fundraising totals, leaderboard rankings, comments, messages, and other information intentionally submitted to public portions of the Platform.

Public information may be viewed by anyone who has access to the Campaign and may be shared through social media, email, text messaging, or other services. Depending on how Campaign pages are configured and made available, public content may also be accessible through search engines or other online services.

You should not submit information to public areas of the Platform that you do not want others to see.

Anonymous Donations

The Platform may allow you to choose to appear anonymously when making a donation. If you select this option, we will not intentionally display your identity publicly in connection with that donation. Your contribution may instead appear as “Anonymous” while still being included in Campaign totals, team totals, leaderboards, and Campaign statistics.

An anonymous donation is anonymous to the public; it does not necessarily mean that no identifying information is collected. SDFB and service providers involved in administering the donation may still collect, receive, or retain identifying information where necessary to process the donation, provide a receipt, maintain financial records, prevent fraud, provide support, administer the Platform, or comply with legal requirements.

3. HOW WE USE INFORMATION

We use the information we collect to provide, operate, maintain, secure, and improve the Virtual Food Drive Platform.

This includes creating and managing accounts, Campaigns, and teams; administering donations; calculating Campaign and team totals; operating leaderboards and competitions; honoring anonymous-donation preferences; generating Campaign reports, links, and QR codes; facilitating social sharing; and providing Campaign progress, completion, and other Platform communications.

We may also use information to provide customer and technical support, troubleshoot problems, understand how the Platform is used, improve its design and functionality, evaluate Campaign and Platform performance, detect and prevent fraud or misuse, protect Platform security, maintain appropriate financial and operational records, enforce our agreements and policies, and comply with legal obligations.

Where permitted by law and consistent with your communication preferences, we may also use information to communicate with you about SDFB fundraising, programs, engagement opportunities, or related activities.

We may aggregate, anonymize, or de-identify information so that it no longer reasonably identifies an individual. We may use this information for analytics, research, reporting, planning, understanding fundraising and Campaign performance, improving the Platform, and supporting SDFB's programs and mission.

4. HOW WE DISCLOSE INFORMATION

We may disclose information when reasonably necessary to operate the Platform and provide its services.

For example, information may be provided to vendors and service providers that support hosting, cloud infrastructure, donation processing, email delivery, analytics, security, technical support, data storage, and other Platform operations. These organizations may process information on our behalf or as necessary to provide their services.

Authorized Campaign Organizers may receive information necessary to administer and understand their Campaigns, subject to applicable privacy controls and SDFB policies. Organizers receiving donor information through the Platform are expected to use that information only for authorized Campaign administration and communications and must respect applicable privacy choices, including anonymous-donation preferences.

If a Campaign is operated for or through a Participating Organization, information associated with that Campaign may be provided to that organization as reasonably necessary to administer donations, Campaigns, donor relationships, reporting, or related activities.

We may also disclose information where reasonably necessary to comply with law or legal process; respond to lawful requests from governmental authorities; investigate or prevent fraud, security incidents, or illegal activity; enforce our agreements; or protect the rights, property, safety, or security of SDFB, Participating Organizations, donors, Organizers, users, or others.

Information may also be transferred in connection with a merger, restructuring, transfer of assets, organizational transaction, or similar event as permitted by law.

We Do Not Sell Personal Information

The San Diego Food Bank does not sell your personal information.

We do not sell donor, Organizer, Campaign, account, or Platform usage information to third parties for monetary or other valuable consideration. We also do not provide personal information to third parties for their own independent marketing purposes.

We may disclose information to service providers, Campaign Organizers, Participating Organizations, donation providers, and other organizations when necessary to operate the Platform, administer donations, support Campaigns, provide requested services, maintain security, or for the other purposes described in this Privacy Policy. These operational disclosures are not sales of personal information.

If our practices materially change in the future, we will update this Privacy Policy and provide any notices or choices required by applicable law.

5. DONATIONS, THIRD-PARTY SERVICES AND EXTERNAL LINKS

The Platform may connect to or integrate with services operated by other organizations, including donation and payment platforms, hosting providers, analytics providers, email providers, security providers, and social media services.

When you proceed to checkout, you may be redirected to or interact with a third-party donation service. Information you provide directly to that service, including payment information, may be collected and processed by that provider and may also be subject to its privacy policy and terms.

Similarly, if you use a social-sharing feature or follow a link from the Platform to another website or service, that third party may collect information about your interaction according to its own privacy practices.

This Privacy Policy applies to SDFB's handling of information through the Virtual Food Drive Platform. It does not govern the independent privacy practices of third-party websites and services that SDFB does not control.

6. COOKIES, ANALYTICS AND SIMILAR TECHNOLOGIES

The Platform may use cookies, browser storage, pixels, tags, scripts, analytics identifiers, and similar technologies to operate and protect the Platform and understand how it is used.

Some technologies are necessary for basic Platform functionality, such as authentication, session management, security, fraud prevention, donation workflows, and remembering user or privacy preferences.

Other technologies may provide functional features or help us understand Platform usage, including how many people visit the Platform, which pages and features are used, Campaign interactions, traffic sources, device and browser characteristics, errors, and general performance.

If social media, advertising, or similar third-party technologies are implemented, they may also support Campaign sharing, promotion, engagement measurement, or similar functionality.

Where required by applicable law, we will provide mechanisms for managing non-essential cookies or similar tracking technologies. You may also be able to control cookies through your browser settings. Disabling certain technologies may affect Platform functionality.

Where legally required and technically supported, we will recognize applicable browser or device privacy preference signals.

7. EMAIL AND OTHER COMMUNICATIONS

We may send transactional and administrative communications relating to donations, donation receipts, accounts, Campaign creation and administration, Campaign progress or completion, team results, security, customer support, and other Platform operations.

Where permitted by law, we may also send fundraising, engagement, or promotional communications.

You may opt out of promotional email communications using the unsubscribe mechanism provided in those messages or by contacting us. Opting out of promotional communications will not prevent us from sending communications that are reasonably necessary to administer your account, donation, Campaign, security, or other services you have requested.

8. DATA RETENTION AND SECURITY

We retain personal information for as long as reasonably necessary to fulfill the purposes described in this Privacy Policy and as permitted or required by law.

The appropriate retention period may depend on the type of information, our relationship with you, Campaign administration needs, financial and donation record requirements, tax and accounting requirements, legal or regulatory obligations, fraud prevention, security, dispute resolution, and legitimate operational needs.

Different categories of information may therefore be retained for different periods.

We use reasonable administrative, technical, and organizational safeguards designed to protect personal information against unauthorized access, disclosure, alteration, loss, or misuse. However, no Internet service, electronic transmission, or information system can be guaranteed to be completely secure.

9. YOUR PRIVACY RIGHTS AND CHOICES

Depending on where you live and applicable law, you may have certain rights concerning your personal information. These may include the right to request access to or information about personal information we maintain about you; request correction of inaccurate information; request deletion of certain information; obtain information about how information is collected, used, or disclosed; opt out of certain uses or disclosures; or exercise rights relating to sensitive personal information or legally recognized privacy preference signals where applicable.

We may need to verify your identity before fulfilling certain requests. Where permitted by law, an authorized agent may also be permitted to submit a request on your behalf, subject to appropriate verification.

Certain information may be exempt from a privacy request or may need to be retained despite a deletion request. For example, we may retain transaction records and other information when necessary to comply with financial, tax, accounting, fraud-prevention, security, dispute-resolution, or other legal requirements.

We will not unlawfully discriminate against you for exercising an applicable privacy right.

California Privacy Rights

California residents may have additional rights under the California Consumer Privacy Act (“CCPA”), as amended by the California Privacy Rights Act (“CPRA”), and other applicable California privacy laws.

These rights may include the right to know about personal information collected, disclosed, sold, or shared; request access, correction, or deletion; limit certain uses of sensitive personal information; and opt out of certain sales or sharing where applicable.

SDFB does not sell personal information.

SDFB will provide and honor applicable California privacy rights as required by law. Privacy requests may be submitted using the contact information provided at the end of this Privacy Policy.

10. CHILDREN'S PRIVACY

The Virtual Food Drive Platform is not intended to collect personal information directly from children under 13 without appropriate authorization.

If we learn that personal information from a child under 13 has been collected in a manner inconsistent with applicable law, we will take reasonable steps to delete or otherwise appropriately address that information.

If you submit information about a minor through the Platform, including through Campaign content, photographs, team information, or comments, you should only do so if you have the right and appropriate permission to provide that information.

11. CHANGES TO THIS PRIVACY POLICY

We may update this Privacy Policy periodically to reflect changes to the Platform, our technologies and practices, legal requirements, or other operational needs.

When we make changes, we will update the Effective Date above. If changes are material or additional notice is required by law, we may provide additional notice through the Platform or other appropriate means.

Your continued use of the Platform following an updated Privacy Policy is subject to applicable law and the updated terms.
